TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your use of the CarBounty Platform, operated by urbanFleet Technology Private Limited (“CarBounty”, “we”, “us” or “our”). By creating an account, posting a requirement, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

These Terms should be read together with our Buyer Privacy Policy, which explains how we handle your personal data.

1.  ABOUT THESE TERMS

These Terms form a legally binding agreement between you and CarBounty. They are governed by Indian law, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019 together with the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000. We may present additional terms for specific features, such as the Deal Seal for your commitment deposit; where they apply, they form part of these Terms.

3.  ELIGIBILITY

To use the Platform you must be at least 18 years old, be a resident of India, and be legally able to enter into a contract. By using the Platform you confirm that you meet these requirements and that the information you provide is true.

4.  YOUR ACCOUNT AND VERIFICATION

You may need to create an account and verify your mobile number to use the Platform. You are responsible for keeping your account details secure and for activity under your account. Please tell us promptly if you believe your account has been used without your permission.

5.  WHAT CARBOUNTY IS, AND IS NOT

●       We are a marketplace. CarBounty operates an online marketplace that connects verified buyers with authorised dealerships. We are a marketplace e-commerce entity and an intermediary.

●       We are not the seller. CarBounty does not sell, own, hold title to, or manufacture any vehicle. Any contract for the sale and purchase of a car is entered into directly between you and the dealership you select. CarBounty is not a party to that contract.

●       We do not handle the price of your car. CarBounty does not collect, hold or pass on the purchase price of any vehicle. You pay the dealership directly. The only amount you pay us is your refundable commitment deposit.

6.  HOW THE PLATFORM WORKS

The buyer journey is designed to be simple and private:

●       You specify the exact car. You tell us the precise make, model, variant, colour and your budget and timeline.

●       You place a refundable commitment deposit. This confirms you are a genuine buyer and unlocks the offer process.

●       Dealerships submit private offers. Up to four authorised dealerships are invited to submit private, competitive offers for your exact car inside the Closed Virtual Offer Room. While offers are being made, your identity and contact details are not shared with the dealerships.

●       You choose. You review the offers and select the one you prefer. Only then are your contact details shared, and only with the single dealership whose offer you choose.

●       We inspect before delivery. Our field team carries out a pre-delivery inspection at the showroom before you take delivery.

7.  OFFERS AND PRICING

●       Offers come from dealerships. Every offer is made by a dealership, not by CarBounty. Offers are indicative and are subject to final confirmation by the dealership at the showroom, stock availability, and the manufacturer’s prevailing prices at the time of purchase.

●       We do not set or guarantee prices. CarBounty does not set, negotiate, influence or guarantee the price, discount or any saving on any car. We do not promise that any offer will be lower than any other channel.

●       Everything is shown transparently. Offers are presented to you so that you can decide for yourself. We do not share one dealership’s offer with another, and we do not coordinate pricing between dealerships.

●       On-road price. The price you finally pay includes the ex-showroom price plus applicable taxes, registration, insurance and any accessories, as set out by the dealership.

8.  YOUR COMMITMENT DEPOSIT

●       What it is. To confirm you are a serious buyer, you pay a small commitment deposit before offers are invited. It is held as a refundable amount and is never treated as our income.

●       What it is not. It is not the price of your car and it is not a booking amount for any vehicle. The vehicle price is always paid by you directly to the dealership.

●       Refunds. Your commitment deposit is fully refundable in accordance with the Deal Seal shared with you at the time of payment. Where you are eligible for a refund, we initiate it within seven working days, to the same payment method where possible.

9.  FEES FOR BUYERS

Using the Platform as a buyer is free. You do not pay CarBounty any subscription, commission, success fee or platform charge for using the service. The only amount you pay us is the refundable commitment deposit described above.

10.  THE CAR PURCHASE IS BETWEEN YOU AND THE DEALERSHIP

Once you select an offer, your purchase is completed directly with the dealership. Invoicing, delivery, registration, insurance, financing, exchange, warranty and after-sales service are provided by the dealership and the manufacturer under their own terms. Any question or dispute about the vehicle, its price, its delivery or its quality is between you and the dealership. We will assist in good faith where we reasonably can, but CarBounty is not responsible for the acts or omissions of any dealership or manufacturer.

11.  PRE-DELIVERY INSPECTION

Before you take delivery, our field team carries out a pre-delivery inspection at the showroom to check the basic condition of the car for your convenience. The inspection is a visual and functional check. It is not a mechanical certification, warranty or guarantee of the vehicle, and it does not replace the manufacturer’s or dealership’s own quality checks, warranty and obligations.

12.  YOUR RESPONSIBILITIES

When you use the Platform, you agree to:

●       Provide accurate, current and complete information, and keep it up to date.

●       Use the Platform only for a genuine car purchase, in your own name or with proper authority.

●       Not post false or misleading requirements, or use the Platform for any unlawful purpose.

●       Not interfere with, disrupt, or attempt to gain unauthorised access to the Platform or its systems.

●       Keep your account credentials secure and comply with applicable law.

13.  PAYMENTS AND THIRD-PARTY SERVICES

Your commitment deposit and any refund are processed through our payment gateway (Cashfree). Calls between you and a dealership are connected through a masked-calling provider (Exotel) so that neither party’s personal number is exposed. These providers operate under their own terms and security standards. We choose our providers with care, but we are not responsible for matters outside our reasonable control.

14.  INTELLECTUAL PROPERTY

The Platform, together with its content, design, software, and trademarks including the CarBounty name and logo, is owned by or licensed to CarBounty. You may use the Platform only as permitted by these Terms. You may not copy, modify, distribute, reproduce or create derivative works from any part of the Platform without our prior written permission.

15.  DISCLAIMERS

The Platform is provided on an “as is” and “as available” basis. While we work to keep it reliable, we do not warrant that it will be uninterrupted, error-free, or that offers will be available for every requirement or from any particular dealership. We make no numeric or comparative savings claims. Any decision to place a deposit, select an offer, or buy a car is yours alone.

16.  LIMITATION OF LIABILITY

To the maximum extent permitted by law, CarBounty is not liable for any indirect, incidental, special or consequential loss arising from your use of the Platform, or for the acts or omissions of any dealership or manufacturer. Our total liability to you for any claim connected with the Platform will not exceed the amount of the commitment deposit you paid for the relevant requirement. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law, including your rights under consumer protection law.

17.  INDEMNITY

You agree to indemnify and hold CarBounty harmless against any claim, loss or expense arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or the rights of a third party.

18.  SUSPENSION AND TERMINATION

We may suspend or close your account if you breach these Terms, provide false information, or misuse the Platform. You may stop using the Platform at any time. If your account is closed, any commitment deposit is dealt with in accordance with the Deal Seal.

19.  CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our services or in the law. When we make a material change, we will post the updated Terms on the Platform and update the effective date shown above. Your continued use of the Platform after a change means you accept the updated Terms.

20.  GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of India. Subject to your rights under consumer protection law, the courts at Gurugram, Haryana have jurisdiction over any dispute arising from these Terms. Before raising a formal dispute, please contact our Grievance Officer so that we can try to resolve the matter directly.

21.  GRIEVANCE REDRESSAL

In line with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, you may raise any grievance about the Platform with our Grievance Officer:

We will acknowledge your grievance within forty-eight hours and work to resolve it within the timelines required under applicable law.
